Hi,
Yesterday i started a new topic asking about copyright protected books .You can read it from here
http://discussion.dreamhost.com/showflat.pl?Cat=&Board=curious&Number=83998&page=0&view=collapsed&sb=5&o=14&part=

Now i am asking a similar question...
There are many free hosting providers available like rapidshare.com, Megaupload.com, 4shared.com.....There are many copyright protected books available in this hosts. Can i place the link to such a file ? (for example http://rapidshare.de/files/20307533/**********.rar)

Is there any problem by placing this link ?

Pls reply.....

This is a bit of a grey area. Although, in the past, sites linking to torrents and MP3s etc. have been taken down, even though they were not directly hosting the copyright material.

Personally, I wouldn't take the risk, it just isn't worth it.

If DreamHost receives a DMCA takedown order, they will most likely comply. Chances are you may face a legal battle afterwards as well.
So ask yourself - is it worth it?

Here's are links to a couple of good stories that I think summarize the court's interpretation of the DMCA with respect to linking:

It depends on whether you consider possibly having your Dreamhost account terminated to be a "problem".

While Google is *full* of references that talk about the "grey" area of linking to illegal content, as well as links to IP lawyers you can pay to argue your side of the issue if you get sued, the Dreamhost Abuse Center is very clear about this issue as it relates to your DreamHost account:

In reply to:

Note that we also prohibit the facilitation of copyright infringement. This means that linking to pirated files (even those located on non-DreamHost servers), operating BitTorrent trackers that primarily feature illegal material, the operation of 'warez' forums, etc. are prohibited.

Obviously, there is some subjectivity to these matters, and it is very easy to accidentally facilitate copyright infringement even if this is not intended. For that reason, we do take a reasonable approach when deciding what constitutes contributory copyright infringement. For example, embedding one or two YouTube videos on your site is a very different matter than running a site whose main purpose is to index and link to downloads of commercial Hollywood movies.

Term: Distribution

For the purposes of our policies, 'distribution' entails either distributing material directly from your account (ie. sharing files from your web space or via FTP) or embedding material located on non-DreamHost servers so that it displays within your server. It also includes willfully facilitating copyright infringement by linking to known infringing works, as described above.

OK, I retract my 'grey area' comment above. wink

I think it may cause BIG PROBLEM for you to host in any hosting company regarding legal section for terms of services.

If you try to provide e-books for educational purposes. Why you don't just contact the publisher and see what they can do it for you ?
